Additional Considerations:

  • Avoid including sample full privacy policies.
  • The policy must be detailed and comprehensive, addressing all facets of data collection, use, and sharing, rather than being overly broad or basic.
  • Compliance is maintained if the company shares other data but excludes SMS consent and related phone numbers, as long as the specified disclaimer is present.
  • PDFs are permissible for privacy policies if they are easily reachable and contain the mandatory SMS statement.

3. Opt-in Language
For website contact forms collecting consent, include a checkbox with this statement: "By selecting this box, you consent to receiving SMS messages from (company name) about (SMS Use Case). You can opt out anytime by replying STOP. For help, reply HELP to (phone number). Message and data rates may apply. Frequency of messages will vary."
